1. Agreement to Terms

By accessing or using any products, services, or websites (collectively, the "Services") provided by ACL Solutions LLC ("Company," "we," "us," or "our"), operating under the brand name PookieB, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use our Services.

These Terms apply to all visitors, users, and others who access or use our Services, including but not limited to SmartSpender, Shredders, News Daily, DayByDay, Harmony Tracker, and Wilco.

2. Use License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use our Services for your personal, non-commercial use. This license does not include:

  • Modifying, copying, or distributing any content from our Services
  • Using our Services for any commercial purpose without prior written consent
  • Attempting to reverse engineer, decompile, or disassemble any software used in our Services
  • Removing any copyright, trademark, or other proprietary notices from our content
  • Transferring your account or access rights to another person
  • Using data mining, robots, or similar data gathering and extraction methods

This license shall automatically terminate if you violate any of these restrictions and may be terminated by ACL Solutions LLC at any time.

3. User Accounts

Some of our Services may require you to create an account. When you create an account, you agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information to keep it accurate and complete
  • Maintain the security and confidentiality of your login credentials
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate your account if any information provided is found to be inaccurate, false, or incomplete, or if you violate these Terms.

  • Use our Services to generate content that is illegal, harmful, or infringes on the rights of others

5. Intellectual Property

The Services and all content, features, and functionality (including but not limited to text, graphics, logos, icons, images, audio, video, software, and the design, selection, and arrangement thereof) are owned by ACL Solutions LLC, its licensors, or other providers and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

The PookieB name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of ACL Solutions LLC. You must not use such marks without our prior written permission.

Any content you submit, post, or display through our Services remains yours. However, by submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute that content in connection with providing and improving our Services.

6. Disclaimer of Warranties

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that our Services will be uninterrupted, timely, secure, or error-free. We do not warrant the accuracy, reliability, or completeness of any information provided through our Services. AI-generated content, recommendations, and analysis provided by our Services are for informational purposes only and should not be relied upon as professional advice.

SmartSpender does not provide financial advice. Shredders does not guarantee snow conditions or safety. News Daily summaries may not capture all nuances of original articles. Any reliance on our Services is at your own risk.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ACL SOLUTIONS LLC, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to or use of (or inability to access or use) our Services
  • Any conduct or content of any third party on our Services
  • Any content obtained from our Services
  • Unauthorized access, use, or alteration of your transmissions or content

Our total liability to you for all claims arising out of or relating to these Terms or your use of our Services shall not exceed the amount you have paid us in the twelve (12) months preceding the claim, or fifty dollars ($50), whichever is greater.

8. Privacy

Your use of our Services is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using our Services, you consent to the collection and use of your information as described in our Privacy Policy.

9. Termination

We may terminate or suspend your account and access to our Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

Upon termination, your right to use our Services will immediately cease. If you wish to terminate your account, you may simply discontinue using our Services or contact us to request account deletion.

All provisions of these Terms which by their nature should survive termination shall survive, including without limitation ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions.

Any disputes arising out of or related to these Terms or our Services shall be resolved exclusively in the state or federal courts located in Sheridan County, Wyoming. You consent to the personal jurisdiction and venue in such courts.

Our failure to enforce any right or provision of these Terms shall not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions shall remain in effect.

11. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Services after any revisions become effective, you agree to be bound by the revised terms.
