Welcome to Pookie B News Daily, a news aggregation and AI summarization service operated by ACL Solutions LLC ("Company," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the News Daily web application, iOS application, Progressive Web App, podcast, and related services (collectively, the "Service"). By accessing or using News Daily, you agree to be bound by these Terms.

1 Acceptance of Terms

By accessing or using News Daily, you confirm that you are at least 13 years old and have the legal capacity to enter into these Terms. If you do not agree to these Terms, you may not use the Service.

2 Description of Service

News Daily is a news aggregation and AI summarization platform that provides:

  • checkAI-generated article summaries and sentiment analysis powered by GPT-4o-mini
  • checkA weekly AI-generated podcast using ElevenLabs Text-to-Speech
  • checkPersonalized watchlists and topic tracking
  • checkReal-time news streaming via Server-Sent Events (SSE)
  • checkAnalytics dashboard with D3.js visualizations

3 Content Aggregation Policy

News Daily aggregates content from third-party sources. You acknowledge that:

  • infoAll articles link back to their original sources
  • infoSource availability and content accuracy are controlled by third parties
  • infoWe are not responsible for the accuracy, completeness, or timeliness of third-party content

4 AI-Generated Content

News Daily uses artificial intelligence to generate summaries, analysis, and podcast audio. You acknowledge that:

5 Acceptable Use

You agree not to:

  • blockAttempt to gain unauthorized access to our systems
  • blockScrape, crawl, or use automated means to access the Service without permission
  • blockRedistribute or resell aggregated content or AI summaries
  • blockReverse engineer or extract the source code
  • blockInterfere with or disrupt the Service's functionality

6 Intellectual Property

The Service's original features, functionality, design, and AI-generated content formats are the exclusive property of ACL Solutions LLC. Original news content remains the property of its respective publishers. You may not copy, modify, distribute, sell, or lease any part of the Service without our written permission.

7 Third-Party Services

News Daily integrates with third-party services including Amazon Web Services, OpenAI (GPT-4o-mini), ElevenLabs (TTS), and various news APIs. We are not responsible for the availability, accuracy, or practices of these third-party services.

8 Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be unavailable due to scheduled maintenance, system updates, third-party source outages, or circumstances beyond our control. We reserve the right to modify, suspend, or discontinue the Service at any time without notice.

9 Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT AI-GENERATED CONTENT WILL BE ACCURATE, COMPLETE, OR FREE OF ERRORS.

10 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ACL SOLUTIONS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING:

  • - Decisions made based on AI-generated summaries or analysis
  • - Inaccurate, incomplete, or misleading content from third-party sources
  • - Errors in AI-generated podcast audio
  • - Service interruptions or data loss

11 Indemnification

You agree to defend, indemnify, and hold harmless ACL Solutions LLC from any claims arising out of your access to or use of the Service, your violation of these Terms, or your violation of any third-party rights.

12 Governing Law

These Terms shall be governed by the laws of the State of Wyoming, United States, without regard to conflict of law provisions. Any disputes shall be resolved in the state or federal courts located in Wyoming.

13 Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will provide notice through the Service or by other means. Your continued use of News Daily after any changes constitutes acceptance of the new Terms.

14 Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall continue in full force and effect.

15 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ACL Solutions LLC regarding your use of News Daily.
