Terms of Service

DayByDay Social Journaling App

Welcome to DayByDay, a social journaling application operated by ACL Solutions LLC ("Company," "we," "us," or "our"). These Terms of Service ("Terms") govern your use of the DayByDay mobile application and related services (the "App"). By accessing or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using DayByDay, you confirm that you are at least 13 years old and have the legal capacity to enter into these Terms. If you are between 13 and 18 years old, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. If you do not agree to these Terms, do not use the App.

2. License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial journaling purposes, subject to these Terms. This license does not include the right to:

  • Modify, copy, or create derivative works based on the App
  • Reverse engineer, decompile, or disassemble the App
  • Rent, lease, sell, or sublicense the App to any third party
  • Use the App for any commercial purpose without our written consent

3. User Accounts

To use DayByDay, you must create an account. You are responsible for:

  • Providing accurate and current account information
  • Maintaining the confidentiality of your login credentials
  • All activity that occurs under your account
  • Notifying us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms or are inactive for an extended period.

4. User-Generated Content

Your Journal Data

You own your journal entries, photos, and all content you create within DayByDay. We do not claim ownership over any content you write, upload, or create. Your journal data belongs to you.

Content License

By sharing content through DayByDay's social features, you grant us a limited, non-exclusive license to display, distribute, and transmit that content to the users you have chosen to share it with. This license exists solely to enable the social features of the App and terminates when you delete the content or revoke sharing access.

Content Responsibility

You are solely responsible for the content you create and share. You represent that your content does not:

  • Infringe on the intellectual property rights of others
  • Contain unlawful, defamatory, or harassing material
  • Include content that exploits minors
  • Violate any applicable law or regulation

5. Social Features

DayByDay includes social features that allow you to connect with other users, share journal entries, and interact through reactions and comments. By using these features, you agree to:

  • Treat other users with respect and kindness
  • Not use social features to bully, harass, or intimidate others
  • Not share another user's content without their permission
  • Not use social features to spam, advertise, or distribute unsolicited content
  • Report any content or behavior that violates these Terms

We reserve the right to remove content and restrict access to social features for users who violate these guidelines.

6. Data Ownership and Portability

Your data is yours. At any time, you can:

  • Export all of your journal entries, photos, and metadata in standard formats (JSON, PDF)
  • Delete individual entries or your entire account
  • Revoke sharing access on any previously shared content

When you delete your account, we will permanently delete all of your personal data and journal content within 30 days, except where retention is required by law.

7. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Interfere with or disrupt the App's functionality or servers
  • Use automated means (bots, scrapers) to access the App without permission
  • Upload malicious code, viruses, or harmful files
  • Impersonate another person or misrepresent your identity
  • Collect or harvest other users' personal information
  • Use the App to distribute spam or unsolicited messages

8. Intellectual Property

The DayByDay App, including its design, code, branding, icons, and features, is owned by ACL Solutions LLC and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App without our written permission. "DayByDay" and the DayByDay logo are trademarks of ACL Solutions LLC.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. WE DO NOT GUARANTEE THAT YOUR DATA WILL NEVER BE LOST, ALTHOUGH WE TAKE REASONABLE MEASURES TO PREVENT DATA LOSS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ACL SOLUTIONS LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of data, journal entries, or photos
  • Unauthorized access to or alteration of your content
  • Emotional distress arising from social interactions within the App
  • Service interruptions or unavailability
  • Any losses arising from reliance on content shared by other users

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE MONTHS PRECEDING THE CLAIM (IF ANY).

11. Governing Law

These Terms shall be governed by the laws of the State of Wyoming, United States, without regard to conflict of law provisions. Any disputes shall be resolved in the courts of Wyoming.

12. Changes to Terms

We may update these Terms at any time. We will notify you of material changes by updating the "Last Updated" date and, where appropriate, through in-app notifications. Your continued use of the App after changes constitutes acceptance of the new Terms.
